Context
A young client turned to our legal team after breaking up with her partner – who had long failed to meet his financial commitments – just before a scheduled move. When she postponed the move 48 hours in advance, the moving service provider claimed breach of contract and attempted to charge excessive contractual penalties.
The situation became complicated when the provider tried to apply terms and conditions from a different company than the one the client communicated with. Both entities were operated by the same individual.
Tensions escalated: communication turned hostile, and there were threats and attempts to extort payment under pressure. The client faced aggressive behavior verging on blackmail and fraud.

Objective
- Assess the legal position of the client in the dispute with the service provider.
- Prevent escalation and shield the client from undue pressure.
- Negotiate a settlement without going to court, avoiding losses for all involved.
- Secure compensation and allow the client a fresh start without financial burden.
Legal Strategy and Argumentation
- We analyzed the contract and identified the key legal issue: the provider relied on terms from a different legal entity than the one the client had dealt with. This is unlawful.
- We pointed out that rights arising from the contract of one entity cannot be enforced by another, even if both are run by the same person.
- We highlighted the provider's inappropriate and aggressive behavior, which bordered on criminal conduct.
- We led a firm but respectful negotiation to keep both parties mindful of their responsibilities.
- We applied the principle: “No one may benefit from an unlawful situation they created themselves”, creating a framework for agreement.
Key Turning Point
The breakthrough came when we explained to the service provider that they couldn’t legally use terms from a different company as a basis for penalizing the client. Once they realized the legal position was untenable, their tactics quickly changed.
Outcome
- We negotiated a complete cancellation of all penalties and fines.
- The client received a CZK 60,000 discount from the original price.
- A new moving company took over her belongings without further complications.
- The original provider issued a formal apology.
- The entire dispute was resolved out of court, free of stress and additional costs.
„I felt like everything was falling apart – breakup, moving, threats. NAWI Europe stood by me in my darkest moment and helped me resolve the situation without unnecessary costs or stress. Thanks again.“
